Todd Whitman leads the firm’s Litigation Department. Todd’s  practice focuses on real estate disputes, commercial litigation, and  risk management. For 25 years, Todd has represented  commercial and retail landlords and tenants in lease disputes  involving unlawful detainer, fraud, and breach of lease  agreements. He has tried and arbitrated lease disputes relating to  option clauses, fair market value determinations, restrictive  covenants, operating covenants, and other breach of lease claims.  

Todd handles commercial disputes relating to breach of  partnership and LLC agreements, fiduciary duty and  misappropriation of funds. He has also represented both individual  and institutional owners in the enforcement of CC&Rs, easement,  and boundary line disputes. Todd also represents lenders in  enforcing their rights under loan agreements, including judicial and  non-judicial foreclosures. 

Although Todd welcomes a battle in the courthouse, he also  devotes a substantial amount of time to keeping his clients out of  trouble — counseling clients on ways to minimize their exposure  and maximize their recovery before there is a dispute, including  the review and drafting of pertinent contract provisions relating to  insurance, indemnification, and remedies.
